STANDARD TERMS AND CONDITIONS OF SALE
Cafe Nort conditions of sale:
- An order confirmation does not mean a binding contract has been formed. We reserve the right to cancel or limit order quantities at any time due to product availability, import delays, or obvious pricing errors.
- Our bakery products are fresh, perishable, and free from artificial preservatives. You, the customer assumes full responsibility for proper storage (cooling, freezing, etc.) immediately upon delivery or pickup. We are not liable for spoilage due to incorrect customer storage.
- In our kitchen we handle major allergens (e.g., nuts, gluten, dairy, sesame, egg). We cannot guarantee 100% cross-contamination-free products. For imported goods, you, the customer are responsible for reviewing the original manufacturer's ingredient lists.
- Delivery windows are estimates, not guarantees—especially for national and international shipping. "Risk of loss" is transferred to you the customer or the courier the moment the package leaves our bakery. For local deliveries, delivery is complete once left at the designated address.
- For international shipping, you the customer are legally considered the "importer of record." You are solely responsible for ensuring the items comply with your country's local customs laws and for paying all import duties, taxes, and customs clearance fees.
- All sales are final. Returns are not accepted. Refunds or replacements are only issued at our absolute discretion in cases of severe transit damage or incorrect items, provided you, the customer, sends photographic proof within 24 hours of delivery.
- We warrant that imported goods are sourced from licensed suppliers and comply with pertinent United Kingdom regulations. However, you as an international customer who buys an imported item from us, you must ensure it is legal to possess that item in your home country.
- To the maximum extent permitted by law, our bakery's total liability for any claim (whether it's food poisoning, a broken tooth on a hard crust, or a lost package) is strictly limited to the exact amount you the customer paid for that specific order. We are not liable for indirect, punitive, or consequential damages.
- These terms are governed by the laws of England and Wales, and any disputes will be resolved exclusively in the courts of Sheffield, UK.
- The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
- We, Cafe Nort Ltd, reserve the right to choose at our sole discretion the courier which whom we send fully paid orders.
- We cannot be held responsible for any delays or failure to deliver by the courier a dispatched on time fully paid orders.
- Cafenort undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. Cafenort cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
- In order for it to be admissible, Cafenort must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
- All our contractual relations will be governed exclusively by United Kingdom law.
- These terms and conditions can be altered, edited or amended as often as Cafe Nort Ltd sees fit without the obligation to notify any existing client or any potential one of such changes.
